Council is inviting comments on Draft Section 7.11 Contribution Plan No 5 – Local Open Space (CP05) in accordance with Section 213 of the Environmental Planning and Assessment Regulation 2021.

What is the plan about?

CP05 is a longstanding contribution plan which collects infrastructure contributions from developers towards local open space in development areas in the shire which are not covered by an area-specific contribution plan.

What has been updated?

This amendment is mainly to correct an error which resulted in a small area in West Kingscliff not being covered by any local open space contribution plan. The error arose because the area-specific contribution plan called Section 7.11 Contribution Plan No 7 – West Kingscliff (CP07) contains two separate contribution areas, one for local open space, and another one for drainage. The drainage area is slightly larger, and the whole of the CP07 area was incorrectly excluded from the map in CP05. This amendment corrects the map for CP05 to exclude only the CP07 open space area.

This amendment also implements the following administrative changes:

  1. Works program items have been numbered to enable better tracking of costs in Council’s financial system.
  2. Clause 2.13 has been updated to replace the discontinued ABS Index named "Implicit Price Deflator (IPD) Engineering Construction" with the ABS Index named "Producer Price Index (PPI) Non Residential Construction NSW" and to add the ability to use the ABS CPI (All Groups Sydney) index when other named indexes are not available.
  3. The works program has been indexed using the ABS IPD (Engineering Construction) to 2020 (when the index was discontinued), plus PPI (Non-residential construction NSW) from 2020, resulting in the following adjustments to the contribution rate in this plan:
    • $305.04 per person for local casual open space (up from $280.57).
    • $349.13 per person for local structured open space (up from $321.12).
