Proposed updates to Community Markets on Public Land Policy

Tweed Shire Council is updating its Community Markets on Public Land Policy to reflect recent changes to planning legislation and to make sure the policy better supports how markets operate on Council‑managed land. Market operators, business owners and residents are invited to review the proposed changes and provide feedback.

We’re particularly interested in hearing:

  • Is the policy clear and reasonable?
  • Is there anything else we should consider?

What the policy covers

The Community Markets on Public Land Policy outlines how markets on public land are to be managed. It sets expectations for market managers, operational requirements and principles to ensure markets remain safe, inclusive and aligned with community needs. This policy only applies to community markets which are held on public land under the control of Council.

What's changing and why

  • Recent planning reforms mean markets on public land no longer require a Development Application (DA). Instead, they will be managed by site-specific Terms and Conditions. View the site-specific terms and conditions.
  • A percentage‑based fee structure is proposed so that market fees reflect the size and earnings of each market, rather than a flat rate.
  • Minor updates have been made to the Market Management Plan guidelines to clarify expectations for market operators.
  • Approved market locations and operating hours are more clearly defined to protect local amenity and ensure each site is used appropriately.
  • Minor wording updates have been made throughout the policy to improve clarity and consistency.
